That clearly states that only Photobucket and other Photobucket members have the "rights" to the pic. If that CarID site isn't a Photobucket member well...

I'm clearly missing where your reading that it states ONLY Photobucket and Photobucket members have rights.

Bottom line it's a very gray area but if you publicly post a photo on the internet and its NOT hosted on your own private domain/website you 9 times out of 10 surrender the rights to that photo, as well as you would have to register with the Copyright Office in order to sue on your rights if you wanted to even go that far.... CarID could just say too bad to her and that's were it would end.

how bout ebay listing pics? I think those are off limits for redistro use.

I couldn't find anything directly related to the photos YOU upload on E-bay's site but they are pretty critical about you committing copyright infringement by uploading something that doesn't belong to you, or was pulled from another E-bay seller's listing.

However this statement about their image and text policy could cover that

You're not allowed to use the following if you're not authorized to do so by the owner, its agent, or the law:
-Photos and text from other eBay users

The only problem is that policy is directly related to YOUR listings.... It doesn't say anything about using photos that were posted on ebay for something else.

But then yes, once it's on the internets it's pretty much fair game. They could tell her to suck it but any respecting business wouldn't do that. Could she fight it and win? Probably not. Would they be dicks if they didn't take it down if requested? Yes.

Watermarking the photo is all that one can cheaply and easily do to hopefully deter unauthorized use.

I had an item for sale on e-bay, someone else grabbed my pic and was trying to sell their stuff with it. I complained to them AND to ebay, and e-bay did nothing. Hey, it was a good pic, it probably would help the jerk sell his stuff and make e-bay more money, of course they are going to sit on their hands... :pardon:

If you submitted through their forms to complain specifically about that they should have done something because it's written in their policy.
