Beretta Fest Code of Conduct and Terms and Conditions
For BerettaFest Registrations - By agreeing to these Terms & Conditions you understand that the Bfest Hotel location is kept private for the safety of the group and the event as a whole AND you agree to keep any and all information you receive regarding the location private from any users who are not currently registered to attend Bfest. If you are requested by someone to tell them the hotel info, your best bet is to direct them to email the board Admins by emailing board@beretta.net or admin@beretta.net. You will be sent the hotel information after order approval; it will show up in the comments of your order history as well as receiving an email containing the comment with your order status update.
For Vinyl - All donations are final. Any damage to decal done during installing is not covered as defective. If decal is damaged upon receipt due to shipping or other scenario, please contact admin@beretta.net regarding possible replacement.
BerettaFest Code of Conduct and Attendee Contract
Section 1 – Definitions
1.1 BerettaFest. BerettaFest (“the Event”) is defined as the event that is organized and held
each year by members of BerettaNet to provide a safe and fun way for Beretta owners
to come together each year. The event location is defined as any facility,
establishment, park, place, locale or area the group has occupied for the purpose of the event.
1.2 BerettaFest Organizers. BerettaFest Organizers (“the organizers”) are defined
as the individuals who make BerettaFest possible. These volunteers include the BerettaFest
Committee Members (e.g. Chairman, Registrar, Treasurer, etc.), local event Organizers and any
volunteers that assist in the planning and execution of the event.
1.3 BerettaFest Attendees. BerettaFest Attendees (“the attendee(s)”) is/are any individual(s)
who is/are in attendance at the event. This includes any person on or near the premises that the
event is being held who associates him/herself with the Beretta Community. Members of the general
public who share the facilities the event is held at but are not associated with the
Beretta Community are not considered to be attendees of BerettaFest. Attendees need not be
registered with BerettaFest to be considered bound by this agreement.
Section 2 – Registration
2.1 Pre-Event Registration. All attendees are required to register with BerettaFest
prior to the event. Instructions on how and where to register will be provided via the Yahoo!
Group Mailing List “Bfest”. A registration deadline will be set by the event organizers and will
vary based on the date of the event. All benefits awarded to paid registrants (decals, hotel
discounts, maps, etc.) are ordered and negotiated prior to the event and are based on
event registration. Event organizers cannot guarantee that any of these benefits will be
available to attendees who did not register prior to the event.
2.2 Registration Payments. All registration payments must be received in good order by the due
date set by the organizers each year. This date will vary depending on when the even is held, but
it is typically 2-4 weeks prior to the event. Acceptable methods of payment currently include
Money Order, Cashier’s Check, Personal Check or PayPal® transfer. A $25 fee may be charged for
payments returned for non-sufficient funds (NSF).
2.3 Late Registration. Event organizers may offer the option of late registration, at their
discretion. If late registration is allowed, attendees will be permitted to register and
pay after pre-event registration is closed up until the event itself. If registering
by mail, the above methods of payment for pre-event registration apply. If registering in
person, cash is the preferred method of payment; however personal checks will be accepted at the
organizers’ discretion.
2.4 Attendees Required to Register. All attendees at BerettaFest are required to
register with BerettaFest. This includes all drivers and their passengers. Since
personal information is not required of passengers, all passengers’ actions may be the
responsibility of the driver. If a passenger has registered independently of the driver,
they are responsible for their own actions. Children 2 and under are not required to register.
2.5 Registration Information. Attendees’ personal information is gathered at the
time of registration. It is required that persons registering provide accurate,
up-to-date information as required by the on-line registration form provided on
http://bfest.beretta.net/registration. This personal information is collected so that in the
event of an emergency, attendees can be identified. It is not the intent of the organizers to
distribute or disseminate any of this information unless required by a Law Enforcement Agency.
Section 3 – Hotel Facilities
3.1 Hotel Choice. The organizers will choose a hotel in the city that is elected to host
BerettaFest. A number of factors contribute to the choice of the hotel including price, location
and reputation of the hotel chain. Every effort is made to ensure that a suitable hotel is
selected. Because event organizers are often working out of state, it is often impossible to
visit the hotel in person. Hotels are selected based on factors that appeal to a large variety of
attendees and the organizers do the best they can to please the majority of the group. The
organizers will always select a reputable national chain, however organizers cannot be held
responsible for the individual hotel owners’ policies and procedures or the actual quality of
the hotel. Attendees are not required to stay in the hotel that has been selected for the group.
3.2 Reservations. It is the responsibility of the registered attendee to reserve a room by the
deadline set forth by the hotel to be guaranteed a discounted rate in the group block. Hotel
information is only given to registered attendees who have paid the appropriate required
registration fee. Reservations made after this date cannot be guaranteed a discounted room rate or
a room in the group block. The hotel reserves the right to cancel or alter a room reservation.
The organizers cannot be responsible for reservations canceled by the hotel due to
overbooking or otherwise. The organizers cannot be responsible if the block of
discounted rooms is filled prior to the reservation cut off date. Rooms are first-come,
first-served so please book well in advance.
3.3 Room Discounts. To benefit the group, the organizers will attempt to negotiate a
discounted “group” rate for registered, paid attendees. There is no guarantee that a discounted
rate will be provided or that the advertised discounted rate is actually cheaper than the standard
room rate. Hotel room rates are set by the hotel owner and are beyond the control of the event
organizers. Attendees are free to book rooms outside of the group block either with
the hotel directly or through a discount travel broker (e.g. Hotels.com, Expedia.com, etc.).
3.4 Conduct at the Hotel Facilities. All attendees are required to abide by all rules and
regulations set forth by the Hotel. Hotel management reserves the right to ask any
person to leave the premises at any time for violating hotel polices. BerettaFest and its
organizers have no authority over hotel management and thus cannot guarantee that any person will
be allowed back into the hotel if said person is forcibly removed from hotel premises by hotel
management.
3.5 Roommates/Guests. Attendees are free to share their rooms with additional persons
to help defray the cost of the room. However, it is the responsibility of the
attendee to notify hotel management of any additional persons that are staying in the
attendee’s room. It is highly advised that this is done in case of fire or other
emergency. Roommates and guests, whether registered BerettaFest attendees or not, are required
to act in a manner that does not disturb other hotel guests. All registered BerettaFest
attendees are responsible for the actions of their roommates and guests.
3.6 Damage to Hotel/Event Facilities. Any damage to any hotel room or any part of
the hotel facility is the responsibility of the person who has caused the damage. Also, any
damage incurred to any event building or facility is the responsibility of the person who caused
the damage. Event facility includes but is not limited to: parking lots, tour buildings,
park buildings, racetrack facilities, restaurants, etc. BerettaFest and its organizers are not
liable for any damage to the hotel or its facilities caused by any individual.
Section 4 – Conduct
4.1 Alcohol and Drug Use. The use of illegal drugs on any premises that the event is held on
and/or at any time during the event is strictly prohibited. The organizers reserve the right to
notify Law Enforcement of any such activity and ask the offenders to leave the premises
immediately. Alcohol use is permitted as long as it is in accordance with local laws. No person
under the age of 21 is permitted to consume alcohol while on any premises that the
event is being held on. Alcohol abuse resulting in excessive public intoxication will not be permitted. Event organizers
reserve the right to ask excessively intoxicated persons to retire to their rooms for the night
and/or leave the premises entirely. “Excessively intoxicated” is defined at the sole
discretion of the event organizers. Essentially, if you exhibit behavior that
is consistent with excessive intoxication, you will be asked to leave.
4.2 Fireworks. At no time during the event may attendees ignite or display fireworks or
explosives on event premises.
4.3 Weapons and Firearms. No attendees shall possess any weapons, firearms or ammunition. If
an attendee has a permit to carry a concealed firearm, it is advised that the
firearm be left at home. If the attendee must bring the firearm to the event, it is advised
that the firearm be locked in a room safe or locked in the trunk of the attendee’s vehicle in a
locked case with a trigger- locking device at all times. Knives over 4” in length will not be
permitted. Any person found with an illegal weapon, or using a legal weapon in an abusive or
threatening manner will be asked to leave and/or the police may be called.
4.4 Littering. Attendees are required to use all available and appropriate receptacles for trash
and recyclables. Cigarette butts should be extinguished and placed in the proper receptacles.
This applies to any facilities we visit as a group, including the hotel.
4.5 Fighting. Fighting of any kind is strictly prohibited at all times during the event. Any
attendees caught fighting will be asked to leave the event immediately. If needed, Law
Enforcement will be notified to break up a fight and/or arrest the offending parties.
4.6 Guests. Guests of registered attendees are considered event attendees, whether or not they
have registered with BerettaFest. Registered attendees are responsible for their guests’ actions
at all times. Guests of registered attendees are expected to abide by this Code of Conduct at all
times.
4.7 Control of Vehicle. Attendees are required to maintain control of their vehicles
at all times. This means operating the vehicle within local laws at all times. No person shall
operate a vehicle under the influence of alcohol or drugs at any time. BerettaFest and its
organizers have the right to report any violations to Law Enforcement as well as ask the
offending parties to leave the event. No person shall allow an unlicensed person to operate
his/her vehicle at any time. All persons must exercise a reasonable degree of security with their
vehicles. This means locking the vehicle at all times when the vehicle is not attended.
It is recommended that all attendees maintain current insurance and registration on their
vehicles. Speeding in parking lots, reckless driving, burnouts, brake tests and/or any operation
of a vehicle that endangers human life will not be tolerated. Offenders will be reported to Law
Enforcement and asked to leave the event immediately. In the hotel parking lot, it is expected
that attendees exercise good judgment and be considerate of other hotel guests. Attendees
shall not excessively rev vehicle engines, play audio systems excessively loud, disrupt
vehicle alarm systems or otherwise use a vehicle to create noise or disrupt other hotel guests.
4.8 Theft. Theft of any kind is strictly prohibited at all times during the event. If theft does
occur, it is the responsibility of the victim to report the incident to Law Enforcement. Event
organizers cannot serve as police but will ask any confirmed thieves to leave the
event immediately. Thieves will not be allowed to register for any BerettaFest events in the
future.
4.9 Vandalism. Vandalism and the damage to physical property belonging to others to
strictly prohibited. If vandalism does occur, it is the responsibility of the victim to report the
incident to Law Enforcement. Event organizers cannot serve as police, but will ask any confirmed
vandals to leave the event immediately. Vandals will not be allowed to register for any
BerettaFest event in the future.
4.10 Hazardous Fluids. Attendees are required to dispose of any hazardous fluids which
include but are not limited to gasoline, race fuel, methanol, alcohol, diesel fuel,
automatic or manual transmission fluid, supercharger oil, octane boost, antifreeze/coolant,
motor oil and power steering fluid. The release of these fluids into the environment is often
common when “parking lot” repairs are performed. Every effort should be made to contain any spills and dispose of these
fluids properly.
4.11 Nitrous Oxide Bottle Warmers. N2O bottle warmers pose a severe hazard when
left unattended. If you use a N2O bottle warmer, please be sure to disable the warmer when not in
use. BerettaFest and its organizers are not liable for any damages, injury or death as a result
of the explosion of a N2O bottle.
4.12 Bartering/Sales. If an attendee wishes to bring items to the event for the
purpose of bartering or selling, the attendee is responsible for all aspects of the transactions.
The organizers will not be responsible for transactions gone badly. If an attendee is interested
in selling an item, it is encouraged the seller engage in the transaction with others present and
with an openly stated price and condition of the item(s). Often times, people argue about a price
or problem with an item after the sale or it's condition. The organizers encourage all
buyers and sellers to do the appropriate research prior to the event, and post items for
sale online prior to the event, when possible. Research may include what the item is worth, the
condition of the item, the availability and the reputation of the seller. Feedback is often
available on beretta.net or bstuff.net. Stealing and a transaction-gone-bad are not the same - so
buy and sell carefully. If an attendee feels they have been cheated it is their personal
responsibility to contact law enforcement, if the problem cannot be resolved privately.
4.13 General Conduct. All attendees are required to behave as adults and treat other
attendees and the general public around the group in a respectful manner. Racial slurs, sexual
harassment, religious or ethnic slander, public nudity, public sex acts or any other lewd behavior
will not be tolerated. All attendees are expected to be polite and courteous to tour guides and
employees of facilities that are visited by the group, including the hotel. Attendees are expected
to abide by all rules and regulations set forth by the various facilities that are visited by the
group. Organizers reserve the right to ask any offenders to leave the event immediately
4.14 Conduct Violations. Any attendee found in violation of any of the above
rules will be subject to consequences set forth by the Committee. At the Committee’s discretion,
any attendee found in violation will be given one warning regarding their conduct. If, after
given their first warning any attendee continues to violate rules and/or endanger any other
attendee, the attendee committing these violations will be asked to leave the event permanently,
and proper authorities may be called. This rule is retroactive to the 2005 Bfest. This means that
anyone at the 2005 fest that was found in violation of these rules is considered warned. This is
for the safety and benefit of the Berettafest community as a whole. The Berettafest Committee
reserves the right to, at any time given the severity of the incident, skip over the first warning
and assess a final warning. At that time the attendee will be asked to leave, and proper
authorities may be called.
Section 5 – Liabilities and Limitations of the Event and its Organizers
5.1 Limit of Liability. BerettaFest and the Event Organizers cannot be held liable for any of
the following: hotel fees, room charges, hotel damage charges, travel expenses, loss of or damage
to personal property, towing fees, locksmith fees, vehicle repair or replacement costs, bail,
citations issued by law enforcement or governing bodies, insurance deductibles or
premiums or other insurance fees, theft, vandalism, injury, medical expenses, loss of life,
attorney fees, taxes or any other financial loss or bodily harm incurred as a result of attendance
of the event.
5.2 Refund of Registration Fees. BerettaFest does not issue refunds of registration
fees for any reason. If you cannot make the event or if you are asked to leave the event, no
refund will be issued. There are no exceptions.
5.3 Registration Materials. Even organizers exercise every effort to have enough
registration materials on hand for all paid registered attendees. The event organizers are not
liable for any missing, lost, misdirected, misdelivered or damaged registration materials including
decals, maps, dash plaques, key chains, etc.
Section 6 – Authority of the Event Organizers
6.1 Authority of the Event Organizers. While the event organizers do not have police power, they
do have the right to ask any person who violates this contract in any way to immediately leave the
event. If persons who are asked to leave do not comply, event organizers may involve
Law Enforcement. Event organizers also have the right to deny registration in future
BerettaFest events to anyone who violates this Code of Conduct.
